Last night a car hit my car in a very busy intersection. Basically I was in my far left lane and she was in the middle lane. She tried to get into my lane but it was too late. I wasn't even going fast, I was going 40mph which would've given me enough time to stop had I seen her trying to get in my lane or even a turn signal which she didn't use. So out of nowhere her car hits mine right by the headlight leaving a dent and some scratches. So my question is should I file a claim? There was no police report and no injuries and her car was a rental with full coverage insurance. She was obviously at fault. What do I do?

Just so you know, the damage was to the side of my car. The head light didnt break or anything, it was to the side of it. And the damage to hers was at the side of her car as well.

She's obviously at fault, in YOUR opinion. The damage was to the SIDE of your car, correct? Not the FRONT headlight, but at the SIDE? Because if it's at the front, it sure is going to look like you were trying to squeeze her out. If damage is to side of your car, and side of her car, she's going to be at fault. If it's to FRONT of your car, and BACK of her car, YOU are more than likely going to be found at fault for this.
And her insurance company is going to come after you with a THIRST FOR BLOOD. That's just how they are.
I would report this to your insurance company.

You should have called the police and filed a report. If you got the information on the other car, call your insurance company and let them deal with it. Assuming you were not at fault, the insurance company will take care of getting your car fixed and then bill the rental company (or their insurance company) for the damages.

Fight it, You say you told your Ins company straight away. Did you give full explanation of how accident occurred, including details of the van & driver and his explanation of reason why he hit you. If so then your Ins company should have got in contact with him (or his company if company vehicle). If your Ins company has done that then the offending driver would have had to fill in forms with his explanation of the accident. The important point here are the initial comments made by the driver. Did you take any photos of the damage, if not and veh is still damaged take some. A good accident investigator will be able to establish if the damage caused to you vehicle is consistent with what he is claiming happened. On reading your question, your damage was to offside wing. He claims you ran into the back of him. In that case 1) damage to your car would be to the front end not offside wing. 2) If you had run into the rear of his van It is unlikely that his van didn't suffer some form of damage, such as cracked rear taillight glass, scuff marks, or transfer of paint from your car onto his. Keep fighting it. Get you Ins company to pursue it, That's what you pay em for. Good luck

You say her car hit yours, but in you narrative it sounds more like you into the back of her rental car, which would put you at fault. At any rate, turn it in to your insurance company because probably the rental company will be coming to you for compensation for damages, and let your insurance figure it out and take care of it.

Part of your insurance contract is that your will report any claim, regardless of fault. You don't need to file a police report. You need to get your vehicle fixed, have the other party pay. Report the claim to your insurance company, and let them do the rest - it's what you pay them premiums for. Good luck & I am glad no one was injured.

I'd definitely report it. Since the other driver had a rental vehicle, she may well get away with not reporting it (although, if she had damage, it will be seen). Tell your insurance company as soon as possible, since they will obviously have to go after her to recoup any loss. Good luck!

I would report it even though it is not your fault. Since she was in a rental car and had full coverage then there should be no problem. Let's hope you got all of her information. Good luck!

the rental car company will file a claim against you for the damages plus the loss of use of the car. should have gotten a police report and contacted your insurance. they may deny the claim since you did not rport it.

Some states have a no fault policy that states that it doesn't matter if it was her fault or not. The easiest way to see if your state has this policy is the go ahead and file the claim. If the claim falls through you'll know cause they will send you a paper saying so.

The rental agency requires insurance so you should file a claim with them. Without a police report or witnesses, it will be your word against hers.
