Last month, whilst on holiday, I had my mobile phone stolen from a locked dormitory room in the hostel in which I was staying (I was away for a shower at the time). The insurance company rejected my initial claim on the basis that my phone was left 'unattended in a public place'.

I was only out of the room for 20 minutes, and there was nobody in the room when I left, or when I got back.

Is it worth appealing? Is a locked dormitory room a public place?

If more than you have access to it, yes.

This is no different than a locked hotel room. If you paid for the room it is not a public place. The hostel lobby is a public room. Appeal the decision with your insurance company.

No, you got screwed.

A public place is somewhere anybody has a right to be, such as a park or even an open store. Your room was not open to the public, and whoever entered it was at least a trespasser and quite possibly a burglar.

Keep fighting.

No because most of the time there are signs that says not responsible for lost or stolen items... as bad as it sounds you shouldve just told the phone company you lost it...
