Hello, I'm experiencing a dilemma. A person's son has opened quite a few accounts in his mother's name and put himself as co-user. He also filed out a few applications in his name but with fake employment info. He hasn't paid the credit cards for a while and his parents found out. Now the collection company is calling for him and his mom to pay the debts they owe. If his mom is willing to take up the debt, will he get in any trouble? Will he also get in trouble for filing out applications with fake employment info?

Not if they bail him out and pay for it all. Of course that is really teaching him something about life. Instead, they need to report the fraud, press charges, and make him learn a lesson. They should NOT bail this guy out.

This sounds like fraud at least as far as the employment info goes. You didn't say how his mother's name got on the account and whether she willingly signed on as a co-user (and just didn't know that he was using false employment info) or if his managing to get his mother's name on the account was fraudulent as well.

If his mother had no knowledge of the fact that she was on these accounts, I think she should refuse to pay and if necessary file charges with police against her son for fraud.
If she doesn't, then she is just setting herself up for more abuse in the future.

If she willingly signed as a co-user but didn't know the son was providing false info, that may be a different situation. Maybe she should check with a lawyer.

In all likelihood if the mother is willing to pay, the son probably won't get into any legal trouble at least as far as the credit card companies are concerned. As long as they are being paid, they will be happy. However, as I said, this would probably just be teaching the son that Mom will always bail him out of trouble and set her up for financial abuse again in the future.

If the mother is willing to pay for the sons crimes, she is NOT helping him at all. Not only is she going to be loaded down with the added debt, she is enabling him, in a way, telling him that it is ok to be a worthless scurge upon the planet. I will bet that she has bailed him out more than a few times in the past, and he still is doing things he knows he shouldn't be.

If I were her, I would be calling the District Attorney's Office and have him deal with what he has done.

He will never change his ways if he isn't forced to face the consequences of his actions. He is headed to jail, if not now, later in life.

If she loves this son of hers, the best thing she could do for him is let him pay. She should call the DA, kiss him on the cheek, and let him face the music. It's called tough love, and sometimes it's the best thing that can be done.

You have a few things going on here. First- It needs to be reported to the police-sister or not. She needs to stop being the "victim". Her family obviously doesn't care one whit whether they hurt her. I say prosecute. Second- Which as far as I am concerned is the biggest scariest part, is you need to think long and hard whether you want to marry into this family. I'm sure you love her dearly, (she sounds way to sweet for her own good) but unless she unties those apron strings and moves onto what appears to be a better future with you, nothing will change. I hope you can convince her.... Best of luck and God bless !

Well, if his mom says she was involved in the original application and takes the responsibility to pay them off, he isn't likely to get into any trouble because the companies won't know what he did.

Of course, this pretty much guarantees that he'll do it again in the future.

If the debt is paid off and the cards cancelled, without the knowledge of fraud and forgery getting out, nothing will happen...
but if the police get involved, there is big consequences for the son,
