should you pay employee when called for jury duty, they actually worked 27 hours and 2 days out so that makes it 43 hrs. should they be paid overtime?

No. FMLA rules count actual work hours per week. Vacation, Sick, Jury Duty, and similar codes are not counted.

He would be paid 27hrs straight time, and 16hrs jury duty.

What state? In Ca usually only if they actually serve on the jury they are to be paid. and then only 8 hrs no OT.

Jury duty must be paid in order that those who will attend it will be actively participating in the proceedings.

No. Common practice is to pay them standard hours if it is due to jury duty.

it should state on the jury summons what is required... ask the employee to see the summons. ;)
