Your brother would only qualify you for head of household if he lived with you more than half the year and you could claim him as a dependent.

Even unemployed, your brother may have income.
In 2007, if he is 19 or older and has more than $3400 in income (including unemployment compensation), you won't be able to claim him as a dependent. Without a dependent, you won't be eligible for HOH.
If his income is less than that, use IRS publication 501 to determine if you meet the support test (and be prepared to proof it). All 5 tests must be met to claim a dependent.

yes... unless there IS someone who lives with you and then i think (not positive) that head of household might be determined by greater income...
(you also have to be 18 or older to be head of household)
