Depends on the state. In SC anyone can perform the ceremony (it's actually the probate judge who validates the marriage certificate.) In AZ you must register in order to get a license to perform marriage ceremonies (religious affiliation is not required.)

He would have to be an ordained minister or a justice of the peace. Deacons and elders in churches are just men that have been giving authority in the church but they don't get legally qualified to perform such ceremonies unless they are otherwise authorized to do so by the government.

It would depend. Different churches use the name deacon and they have different qualifications for the position. You would need to be a justice of the peace, ordained minister, judge or sea captain on a boat in international waters to marry in most states. In the Catholic church, deacons can do a lot of things however, they cant say a nuptial Mass for a wedding.

Depends on your faith, but most likely no. In the pentecostal/baptist church, a deacon is a staff member. He has not attended course, has not been ordained (i.e. ceremony bringing him into the circle of ministry), will not be preaching to the church or advising members, etc. He is called upon to help the minister, manage certain church responsibilities, and serve the church wherever needed - he is not a leader.
However, if it is truly important that he marry you, have him get qualified under justice of the peace. You'll have to research, but the fee to get "certified" depends on your state and the specific duties. It can be done, though.

It depends upon what religion. My dad was an ordained Deacon in the Ukrainian Catholic church, and performed lots of weddings.

Yes, they can. The Deacon at my church (Catholic) performs many wedding ceremonies. He does the ceremony only weddings. The weddings that have mass with them are done by the priest. Just ask him. he'll know whether or not he can perform a ceremony. If he can't he'll tell you. Either way I'm sure he'll be flattered that you asked.

Yes, we were married by a deacon. They can do everything a priest can except hear confessions.
