You can use YOUR uninsured motorist coverage to have your vehicle repaired. If you don't have this coverage you can use your collision coverage and your insurance company will go after the person who hit you for the bill after your car is repaired.

You insurance should pay if you have full coverage or UN-insured motorist. If not, and you feel it is their fault, you have to take that person to court.
People scream (those people with out insurance). I got the shaft from some one who hit me in the rear who had insurance. They said I changed lanes quickly and then hit my brakes. It is true I changed lanes but it was a good five seconds later after I had to slow down. If I was not there he would have hit the car in front of me. HE HAD INSURANCE. The insurance would not pay. I could never resolve the problem because I could not find the person to serve the sepiana.

If you are hit by an uninsured motorist it is there fault for the accident but your insurance will make you pay you deductible for the claim. The only way to get back you deductible is to take the third party to small claims court for the deductible amount. The problem with this is if they have no insurance chances are they don't even have enough money to pay you back your deductible that you already paid out. The only other way to handle such a problem is to get them to pay a reputable body shop for the repairs and a rental vehicle if required up front before repairs are started.
I work for a body shop in Ontario and have dealt with these issues over the years. Usually what happens the person who hits you tries to have you go to a body shop they know to have the repairs done. Sometimes this is worse they trying to get you deductible back from them. The shop repairs what you can see but does not repair all the damage in behind what is visible. This keeps the repair cost down for the person paying but does nothing good for the person they hit.
My recommendation is to follow through with the insurance claim and get your vehicle repaired at an approved facility and get a warranty with the repairs. Even though you usually have to pay your deductible, sometimes it better to pay that then not have your vehicle repaired properly and have to pay to fix it right out of your pocket.

If the policy you bought has you covered for the loss with no-fault insurance you should still be protected by your own company.
Your still going to be out your deductible, that hurts.
You could if your not covered and it is worth the time and expense take the other party to court.
Make sure you get a police report and don't let up on the police to charge the other party, they said to me I don't think we will lay charges against them but they were at fault, it was no time to be nice so I pushed the issue strongly and they were charged with following to close.
A friend had the same thing happen and being nice agreed not to press charges in the end he got screwed by the person that rear ended him.

Well on May 23,I was rearended by a Hispanic women in a dark green suv at a redlight who just took off,I wasn't able to get her lincense plate number,but seeing as how she didn't stop probably means that she was without a valid lincense or insurance.So basically im going to get to be the one who has to pay a 500 deductible thanks to some women who tailgates and tries to outrun a redlight when somebody is in front of them with their brake lights on. Of course her 10 year old daughter was in the car that screamed out are you okay,which leads me to the conclusion she probably didn't speak English. Of course the accident happened in Santa Ana on w civic center drive and birch st. Santa ana home to hit and run drivers of orange county.I have a compact car too so being hit by a large suv that rearends you and takes off can really make you very agitated.I think Ill be spending a lot of my free time trying to catch that women or possibly hiring a PI.I even filed a police report but I wasn't able to get the lincense plate number so Im screwed.Besides basically if you want to catch anybody and sue them,You should hire a P.I or try and find them yourself,because police have too many people to go after to devote to your individual cause.

Check your insurance policy to see if you have uninsured motorist coverage. Then you'll just have to pay the deductible to get your car fixed. Then your insurance company will go after the other driver to get reimbursed.

Take them to court and sue for the damages. You will probably win. If ever someone crashes into someone from the back they are always at fault. You should not be so close to a car that if they stop short--you hit them. So sue the person--you will win.

Your insurance has a line item in it for 'uninsured motorist' in the event something like this happens. Your insurance will cover it, but they will also go get her for the money...

Yeah, sucks to live in a state where insurance is optional...however, if I am not mistaken you are going to be responsible for the damages and the sucky part is that your rates will go up at well....however, if you have all of her info and it is correct then you could always take her to court...but, that could be more costly than getting your car repaired...tough decision, but one that you will have to make....

depends where youre from exactly. insurance laws vary from place to place. im from ontario canada, and here it wouldnt matter. it still counts as a no fault accident and my insurance would just pay to have my car fixed, without my rates rising, and she would likely be charged by the cops for having no insurance. i think its like a 5000 dollar fine, so yea, shed be responsible... for coming up with 5000 bucks hahahhaa.
