If I specify in my will that upon my death, my child is to go to my parents, could her natural father contest the will and possibly be granted custody of her? I live in Pennsylvania, not sure if that has any effect on the answer.

If the father can prove he can take care of her and wants her then the Grandparents can't do much about it. Most states don't have grandparents visitation laws. Check into this if it is a concern to you. If the father is unfit maybe you should get some proof now just in case your parents may need it. I hope you aren't ill now.

Ok American rules im not so sure of but in australia if u have full custody ordered by the courts the father cannot take a child its kidnapping! Im guessing he would have the right to contest the will, you may need to provide some legal reason why your child shouldn't be with the birth father.

If he can prove that he is a good father and that you prohibiting him from having custody of your daughter in the event of your death could directly harm the physical or psychological well-being of your daughter then he has a chance to gain custody.

Yes he can. Bio parent has first say. Grandparents can get custody once he decides he won't challenge the will.

welll i thought that if ur the parent who has custody then she will go to who ever you want. but if its not the case, if shes old enough she can tell the court who she wants to live with. So just tell her grandparents...lol...hope this helped.

You cannot leave her to your parents if her father is alive. They will give her to him instead. If he is not in her life they would probably leave her with your parents though.

No matter what you say in your will a judge decides and it doesnt have to be who you choose.
