WOW...Lots of stuff. Loaded or unloaded a firearm is a firearm. The first piece of advice is consult an attorney. You (or he) can stand mute (basically not say anything) which is his best interest. Emancipation means he is responsible for himself. This could be an issue when the court having jurisdiction charges him with whatever the circumstances allow them. He's in trouble. How much trouble? It could be a lot of trouble (jail/prison) depending upon the circumstances.
