No. I do not think it is fair. Our country was founded on religious beliefs and if we who are Christians want a nativity scene who has the right to take that away?
I see menorahs and it doesn't offend me. I won't throw rocks in their window or try to have them banned. If I didn't want to look I just wouldn't. but I respect their beliefs and freedom of choice.
I am so mad at the troublemakers who want to change our way of life, our freedom of choice, because they dare to be different. Let them be non-believers, just don't look!

There seems to be a simple solution to this, I am not an expert on real estate law...but I'm fairly certain this is legal. Have the city, since the mayor and attorney are approving this, lease the land the Nativity set sits on to a local church for the winter months. This is well within their rights to do so. Once it is leased to the church, they can do what the want with it, as long as it is not illegal. No issues with separation of church and state here, since the church is leasing the land...there would be an issue if the city tried to prohibit them from setting up a Nativity scene once they leased the land...because of that same separation of church and state law. All you would need then is to raise money for the local church to lease the land. Again, I'm not an attorney, so maybe you should have someone run it by the city attorney.
It is easier to use the law to your advantage then it is to fight the law. Does anyone see a problem with doing it this way? Maybe you should post this as another question, to see if anyone thinks this wouldn't work. Hey, it is worth a try.

We have a city park in our town , it's huge. Anyone can put up their religious symbols. It's usually businesses and churches but there are sculptures, paintings and Christmas decorations depicting all religions, even Masons. From the moment it opens there is a long line of traffic every night to see what's been added. There has been no discrimination at all. That's the way I think it should be. We all come together and worship by decorating in our own way. For those that don't believe in any religion, just don't look. I agree with you that slowly Christian's rights have been dissolving almost to the point of having to keep it hidden from the world without being persecuted because of it. Of course this has been revealed to us in the bible along with the Jewish religion. And Jews are God's chosen people. So why not abolish their rights to have menorahs? Well I wouldn't dream of doing such a thing. Can't we let each other alone for a few weeks to celebrate as we want? Or not celebrate. Who is it hurting? For those of you who these symbolism's offend, grow up, shut up and stop whining. Will someone throw rocks in YOUR window for being a non believer?

I really enjoy nativity scenes. I grew up in a secular home where we put up angels, nativity scenes, and small train towns every year. I can put what I want up in my own home.
I am not Christian, but I might even travel to a local church to see a nice pageant, too. That is the appropriate place to put them on.
Heck, I might even travel out of my way to bigger city just to see a really good live nativity scene.
I hope they do not use a real infant for Jesus though; since Jesus was born in the spring the little actor must really be freezing himself in the winter!

I already believe that Christmas is the time of year we , in the PAST and today STILL celebrate the birth of Jesus. That is after all what this time of year is about.
I think all cities and towns with CHRISTIANS and all who support this and OTHER CHRISTIAN symbolism during this time of year, should put up their OWN DISPLAYS on their lawns EVERYWHERE....
ANNOY the HECK out of the ACLU... We shall see how long it will be before such is no longer legal even on PRIVATE PROPERTY! Till then UNITE!

Honestly, yes, I do think it's fair. In my humble opinion, government- whether federal, state, or local- shouldn't have any connection to religion whatsoever.
How about someone volunteer to set up a nativity on their own private property? I think that'd be a good idea. Just a suggestion.

You know, I'm so sick of this kind of crap! No matter what a person's religious beliefs, if people would stop trying to demand that everyone live in a generic world where political correctness reigns, and everyone is "right".......and just show a little love, compassion and respect for their fellow man, maybe they'd be able to live and let live. If you don't like nativity scenes, suck it up and at least respect those who do. The same goes for any other belief symbols. Put up a flying spagetti monster if you want! Geez!!! I'm sick to death of this ME...ME...ME mentality. This country belongs to ALL of us---not just one group of people.

They may succeed in taking the Nativity from our Court House lawns, but how are they ever going to outlaw it in our hearts? Those who protest such are so completely void in their hearts and hate is all they have left. Want to see some great Nativity scenes? Visit any small town in Texas and you'll see plenty.

I think it is just silly
the nativity is almost traditional at this time of year ... and I am not Christian
but in saying this
I would love to see festivals and ceremonies on public display from all the worlds religions also
imagine how bright every day of the year would be in town centres
so if you want one to stay ... fight for them all to be displayed
