My girlfriend is italian and she used to came and visiting me with a Tourist Visa.Last time the homeland security deny her entry and told her she will be able to come back just with a Fiancee Visa. For some personal problems (I'm trying to get divorce, I've been saparate for 5 years cuz my wife left me and this happened before i met my new girlfriend! We just weren't happy together no more and right after we splitted I had to moved 4 years overseas for work so i couldn't get divorce before cuz down there it was really expensive) I didn't apply for a Fiancee Visa yet even if do wanna get marry with her. Do you guys know if there is a other LEGAL way to get her in untill I get my divorce finalize and apply for a Fiancee Visa? Thank you all for your help!

No one said Homeland was lying, what the f***. I was just asking if we have a other choice untill a can get a fiancee visa. I didn't talk about getting her in illegally.

Well, if she tried to come in on a tourist visa and was turned around, there's not a lot of options left here. She's no longer eligible to come in on Visa Waiver, and it's very unlikely that she would get another tourist visa if she applied. Whatever happened at the airport is now in the system and available to all immigration and consular officers. Obviously, you can't file a fiancee petition while you're still legally married. Potentially, she could apply for an H1b skilled worker visa, if she has a university degree and can find a US employer willing to hire her and file the paperwork. But those visas are limited in number and run out every year, even if she is qualified. I don't see any short term solutions at the moment, but as an Italian, she could file for the Diversity Visa Lottery. Chances are slim she'd win, but if she did, she'd have her own green card. There are reasons for her to have been denied.
A fiance visa would not apply because you are still married.
I'd just wait until your divorce is final and then apply for a fiance visa, which will give her 90 days in this country before marrying.

Get her to apply at the local embassy in her country to see if they will allow a Visitors Visa if not for 90 days then a possible alternative?
You dont know till u ask m8, i'm trying to move to america to be with my partner too but as u know already i can't marry her till May ( you replied to my post already )

Good answer from George.. your GF basically can't come to the US; they think she is trying to immigrate (oh wait! She is!).
Go visit her in Italy or a 3rd country until you're free to marry. At that time, you can petition for her and eventually she can move to the US to marry you.

as long as you stay interior america and he or she is vacationing on a common foundation you have got this undertaking. it somewhat is a valid difficulty for CBP and that i does not waste my time or funds attempting to combat this. the least complicated difficulty to do is have an envelop with the latest information that they choose for and in simple terms pass with it. They probably thought she was going to stay and that's why they denied her entry.
At this point, if you want to see her, you'd have to go to a 3rd country or you go to Italy to see her until you feel ready and file the fiance visa.
edit: they have the right to turn her away if they think she will stay.
