My brother and his ex wife have shared parenting over my 8 year old nephew. My brother has him EVERY weekend, while his ex goes out and parties and he has him 2 -3 days during the week. During the summer, he has him for weeks at a time... his ex wife makes more money then my brother does, but my brother has to pay child support. How does that make sense? He has him just as much as her if not more sometimes and she makes more money. She even violated a term in the divorce decree, he isn't in the school district he is supposed to be in, when my brother talks to the courts about it, they act like they don't care, is this right?

No it is not right, unfortunately our system is not perfect. Here is your word to the wise though, come his 11th birthday, if he wants to live with Daddy he is legally able. Now I would double check for your state, but it should be that age. There are always loop holes, be aware to look into them. Make sure your brother has a good lawyer too, a Family Law practice specializing in Divorce is the best way to go. Hope all turns out well and God Bless!

Maybe your brother needs to talk with an attorney?

His ex wife can go out anytime she wants, that's not the issue... the issue is, why should he pay support when the child doesn't spend time with the mother figure?

Your brother needs to take action, or just live with it.

No, its not right! His ex-wife needs to do her part by helping your brother take care of their son! Besides, who does she think she is by going to parties and having a good time while your brother is taking care of his son and he's taking full responsibility for his actions! His ex-wife has made her bed and layed in it, so she can have her cake and eat it, too! She can't have it both ways, so its up to your brother to action against her, so she needs to be in her place! Continue to be there for your nephew and your brother because they're going to need it! Good luck!

Your brother needs a lawyer, but chances are if he didn't contest the move when she left the school district, it's too late now. He can get his child support re-evaluated, however.
