There has to be something else going on that you aren't telling or you don't know.. Child services CAN NOT and WILL NOT take your child just because you decided to home school him instead of public school. That is crazy.. they have enough crappy parents to deal with who are abusing their children than to worry about parents who choose to home school. It doesn't matter whether your child is autistic, able bodied, has down syndrome, or whatever.. it just doesn't happen..
You need to get the facts straight and get a lawyer.

Why would you decide to home school an autistic child? Sorry but that child needs to be in a special education class room I highly doubt you can give him/her the best education possible and child services ONLY takes away your children if they have good reasons you probably shouldnt get your child back if you are this stubborn and put your selfish self before you special needs child
BUT social services would not have taken your child because you decided to homeschool UNLESS in your state that is a form of Neglect you arnt telling us the full story here woman so no
no one can help you fight child services because you are lying
Makes me wonder why God lets crazy ppl have kids in the first place....

I had a child taken from me at birth because i was told people with epilepsy aren't allowed to raise kids, and even though my 4yr old was still living at home with me i fought tooth and nail to get my child back because my rights were violated. In most cases a CAS worker will not apprehend a child for homeschooling. Usually they will say the child is "at risk of harm" or "has been neglected" and not providing prpoper education for a child that is autistic may be considered neglect. Are you qualified to teach your child at home? Can you provide everything your children need? There i so much you aren't telling us here, but i know from my own experience that children taken into care are taken for severe reasons.
Have you gone to legal aid yet? If they apprehended your children you will have a chance to plead your case in court 5 days(in most cases) after the children were taken.

I would call a lawyer ASAP and get all the information on your Parental Rights. Home Schooling isn't illegal and that should have not played a role in any Social Services action. Locate a lawyer who specializes in Family Law and you should receive a free consultation on the matter----never worry about payment, most lawyers have plans for payment options. Get a lawyer, talk to hslda www.hslda.com and to the Autism society. As for the ignorant people above who spout about things of which they do not know, ignore them.
Child services have taken children because of false accusations before and they will continue.
I homeschool my kids, one of which is dyslexic and one has Aspergers. The other is gifted. The one on one situations you get with homeschooling is SO much better for ASD kids then the jumble of a public system.

If its true like you say your child is intelligent and doing well from home care then you do have a good case in court. As long as there is no neglect then you should be ok

You should seriously reconsider whether or not you made the best choice for the child. If they took your child, then they probably had more reason than just the school thing. I would suggest contacting a lawyer. a pro bono one if u can't afford it.

sorry a delayed child should be in public school special ed so that the child can get the needed therapies i also think theres more to your story than your telling
