The baby needs a passport - and both parents must be present to get a passport. Of course, since she came in illegally, she'll probably leave the same way.

Of course you should notify the authorities if she does it.

is kidnapping all the way. keep in mind that because your kid is the son of a Mexican citizen that gives him the Mexican citizenship right away (without loosing the American) not that that makes things better or worse but it could have an impact since they could both go to mexico without a stay limit and you cant

No it's not unless a court has ordered a custody agreement. Under U.S. law,either parent may take the child wherever they please so long as they are not violating an order.

unless you have custody of the kid no its not kidnapping.... this happened to my stepsister and she had to go to mexico to get her daughters back because the father took off with them.

talk to a lawyer. what did you expect when you found out she was illegal? get the kid and let her leave. stop getting with illegal. whats wrong with marring a United States American or a legal immigrant? scared they might have a back bone?

Thanks for the laugh. No, worst case scenario it would be custodial interference and only if the courts had granted you custody. I have to agree with the others here. Good riddance to her.

Heck, I'll even pitch in for her plane ticket if she promises never to come back.
