My mom found out today that somebody has gotten a hold of her atm card, and pin, and over the last month or so has stolen over $1000. We think we know who did it, but don't have any proof so we are letting the bank, and police handle it.

The reason I care though, is if it IS the person I am thinking of, his mom just died. And I really don't care about him at the moment, but his Dad is hanging by a tread. She basically died a slow and painful death for two years, and there was NOTHING he could do but watch. So if it was his son, I want to know what kind of punishment is in store.

He is an adult. For my parents sake, I hope they throw the book at him. I just feel bad for his dad. This won't in any way stop us from trying to get him convicted, I just still feel for him.

Sometimes not much more than paying it back, and only that if he is able to pay it back, depending on the criminal record.

That is a felony,and she is the victim of Identity Theft. If you think you know who did this, Alert The Police and tell them why. Whom ever did this will go to Federal Prison for a few years.

Losing loved ones is not a reason to steal. My dad died in 2004 and Mom died in 2005. I didn't start stealing. My eldest brother died from injuries he received in a Motorcycle Accident in 1978.. I did not start Stealing. My second Eldest sister was murdered in the Downtown Atlanta Hilton as she walked to her car after work by her estranged husband who then turned the gun on himself. he died two hours later in surgery. I did not start stealing.

He will be a convicted felon and he will lose his right to vote and his right to own guns.

well, seeing as the bank is involved, you don't have to worry about California, that's a federal crime.

A thousand dollars, felony...

Possible larceny by conversion...

If he's a minor, he should see the outside, sometime before he turns 21.... if he's an adult, or close to and they try him as an adult... much longer. Could be 20 years.

Regardless of the situation with this person, I would hope the judge would show no mercy.

In most states it is felony theft and the sentence will depend on prior convictions, the judge and how good your attorney is.

your ATM card is protected.

THE BANK WILL INVESTIGATE AND CHARGE IF NECESSARY. COULD BE ASKED TO DO RESTITUTION AND PAYOFF AMOUNT TO BANK.

MORE THEN LIKELY THIS IS THEFT OF AN ATM CARD. FRAUD, INTENT TO COVERT ACTIVITY, UNLAWFUL USE OF ATM CARD, FORGERY ETC ETC.

I FEEL WHERE YOU ARE COMING FROM ABOUT THE CARD AND DAD, BUT THE SON HAS TO BE APPREHENDED AND CHARGED.
