My mom was hit by a moving vehicle ( she was walking). She has been in alot of pain for the past month..unable to leave her apartment..and has a nurse coming into her apartment, tending to her wounds. Im wondering how much money she can expect to receive for her pain and suffering?

The lady who hit my mother, admitted it was her fault. So there is no dispute as to who is at fault in this case..no it wasnt in a cross walk. My mom was crossing a side street and this lady wasnt watching where she was driving and ran into my mom. Any clue as to what my mom can expect in regards to an offer for pain and suffering?

Ok..I see what you are saying. An adjuster did come visit her today..and took all the details. How long does it usually take to settle something like this?

Depends on the type of injuries your mother sustained and the amount of coverage provided by the at fault driver's policy.

There is no chart out there that says Pedestrian's get $x.xx.

Each claim has to be evaluated on its own merits.

Vehicluar accidents involving pedestrians almost always are considered the fault of the driver. Generally speaking, pedestrians always have the right of way.

Suggestion:

Mom should not be negotiating a peaceful resolution directly with the insurance adjuster. She should obtain some legal advice from an attorney which can reasonably estimate her loss. Based on what I am hearing from you, your mom may have a policy limit case. An attorney would probably not even charge any fees and just take payment at time of settlement/judgement.

First of all, are her medical bills being paid by the driver's insurance. If you live in a state that has personal injury protection (PIP), the PIP should be paying for her medical bills and lost wages, mileage to and from doctor visits and physical therapy. The amount they will pay to will depend on how much coverage the driver has.

I assure you, the insurance adjustor is not going to let you see the driver's declaration page to determine how much coverage the driver has. That adjustor is NOT your best friend. Shop around for an attorney, but do not sign a fee agreement with the first one you meet with. Make sure you have one that does plaintiff work on personal injury.

Depends was the accident the other persons fault or not. Was mom in a cross walk or no. Some of it depends on the other persons insurance.
