I paid 1K to a company to provide a service to a business I took over from a previous owner from September 1st till January 1st. I ended up closing the business halfway through. I called and asked for a refund. The business owner told me that I had actually paid 1K for the previous tab the business had before I got on. When I originally spoke with the guy to make payment, he said that I was paying for Sept 1st to Jan 1st. My credit card company is Discover. Can I tell them I want a chargeback of my money since the merchant defrauded me?

By the way, to be fair, I only asked the operator of the company for a refund of 50% of the money that was paid since that was all that was used

Contact Discover by phone and explain your billing dispute. Also write a letter to cover your legal bases. If you do not get satisfaction, contact the Federal Trade Commission at www.ftc.gov

Assuming it's a service where the work performed is steady over the service period, you should get half your money back, unless of course it was agreed there would be no refunds.

Did he know about the ownership change at time of order? If not, he may have found out about it after you agreed and feels you are responsible. He would have a strong case, and it would be tough to get half your money back.

If that's NOT the case, then call Discover. If that doesn't work, take him to small-claims court.

When you bought the business you also bought credit and debit which should have been clearly stated when you viewed the balance sheet. If not, you may have a civil case against the previous owner but probably not a creditor.

Your time for the chargeback may be up . but I would try it and then pay for what I owe.
