Was the person on your property with your permission? In some states this can make a difference.
What is the condition of the tree? Is it alive or dead/dying?
The easy thing to do is contact your homeowners insurance and let them know about the incident. They will do an investigation. If they determine you are liable - they will settle with the car owner. If they determine you are not responsible for the car's damage - they will hire an attorney to defend you.
In tree claims - it is important to turn these claims into your homeowners insurance as soon as they happen.
The reason being - as a rule - if the tree is healthy and something causes it to fall (say a storm) you may not be liable for the damage to the car. As soon as the tree comes down - it starts to die. It is very common for law suits to arise out of these types of situations.
Call your homeowners insurance company and let them know about the loss.

If the tree was a danger, and you were aware of it, and did nothing to solve the problem, you are responsible. If not, it was an act of god. If the car owner has collision insurance on the car it will cover it.
Bottom line, if you weren't negligent, you have nothing to worry about.

thats very horrible. Yes, you are liable.
The Good news is: your homeowners insurance is designed exactly for these sorts of things. So they will pay.
The Bad News is: if you dont have homeowners insurance you will have to pay unless the owner of the car doesnt come after you.
P.S. you should look into if the owner of the car intentionally made the tree fall on his car so that you would be liable. There are many scams like that going around these days.

we just had something similar happen - our insurance said that it was an act of god so we were not responsible. Is that parking space assigned to you (like in a condo or townhouse neighborhood) if so then the person shouldnt have been there in the first place

i dont know the laws that exist in your state, but i would contact the police and have them take a look at the damages. the local authorities will know what to do. it is always a good idea, whenever you get in an accident, to call the police so they can be a reliable witness to whatever happened. :D

Were they parked there with your permission? If you invited them, then probably yes. If the just parked there with no permission or invite then prob not.

If you let them park there, then your home owners policy should cover it, if you have one. If they parked there without your permission its there problem.
