was in a car wreck sun [not my fault] have whiplash and am extremely sore-------the other ladies ins rep is calling next week to see how im doing [yes i went to er to be checked]
and they offer a pain and suffering amount. how does one determine this? hopefull an attorney will answer this

I used to work for an insurance adjuster and pain and suffering was usually 3 times your medical bills.

Number one, do not rush to settle with the insurance company..Case in point...I was in a car accident (passenger of a car who was not at fault). No one was hurt initially. It wasn't until 3 weeks later (no joke) that I began experiencing migraines. I had a multitude of tests (CT,MRI, Xray) and I ws diagnosed with whiplash. It has been 10 1/2 months of pain and I still experience it. I have over $32k in medical bills.

So please wait a little before settling in case you get more symptoms later. These symptoms can last a life time.

Yes, a chiropractor can help, but so can a good pain doctor. If you have continuous pain, you may want to try steroid injections and nerve/pain blocks. You should def see a regular doctor and get him/her to refer you one. You don't need a referal for a chiropractor. Just be careful because they are known to be money hungry and insurance companies tend to hate them.

I cant really answer your question about pain and suffering amount. Personally, if you just got in an accident last week, you have not suffered that much so you probably wouldn't get much if settled soon. I have heard it is three times your medical bills, which would be nice, but I don't think that is realistic. That might be if you get a lawyer, but at least 30% of it goes to your lawyer.

Well, in the hospital when they ask about your pain level it is on a chart on the wall. From 1 to 10. 1 being mild and 10 being HORRIBLE.

This is a Grandmothers advice from personal experience.
I totaled my car about 25 or 26 years ago. The only thing I got was side to side whip lash. I didn't get to the Doctor, I didn't think it was anything to worry about. The pain did not start till the next day.

I have now dealt with MAJOR neck problems for all of these years.

GET TO YOUR CHIROPRACTOR. He can analyze how severe it is, xray for any internal damage and set a schedule for correcting it NOW. Do not wait like I did. Take care of it while it is fresh.

do not talk to thier insurance till u have talked to yours(if you have one) a doctor and a lawyer. they will all help u decide how much. it is probally to soon to know for sure if you will have complications later in life.
