My ex fiance and I have a 17 month old daughter..He's met her twice. I have gone out of my way to try to involve him, even had her first birthday party at his parent's house. I have sent pictures, cards and gotten no response. In June I asked for help with daycare and he said he would see..I waited and waited and finally told him he was a jerk and I would let the attorney general handle it. I tried tonight to talk to him on yahoo i/m to see if we could be cordial and work things out to no avail. My question is could I just let the attorney general handle my support case and just hire a lawyer to do my custody? I'd like sole physical custody of our daughter, but I will allow visitation..Im in Texas if that makes any difference. Also the father is going to college in Alabama should I give the Child support officers his college address or permanent address in Texas? Will they still make him pay something even if he is not working and being supported by his parents? He is 24 years old.

You should go to your local department of human resources and file an application for child support. It will take a while to get anything done, so be patient. Yes he is obligated to pay even if he is not working; the judge will tell him to get a job within XX amount of days or go to jail. Also, depending on the laws in your state, you could win sole legal and physical custody just by the fact that he has made no attempt to make contact with the child or provide support for her - it's considered abandonment.

PS: Also depending on the laws in your state, you should be able to get retroactive support going back at least two years. All this and more should be explained to you if you file with DHR.

People have got to learn the Socialism will never come to America through violent revolution. It comes incrementally. First, minimum wage, now, maximum wage. Universal Health care is another. A lot of people here believe the government plan will be voluntary. But notice, Obama has already floated the idea of making you company provided health insurance compensation taxable income. They are trying to pass a law called "Employee Free Choice Act" that would eliminate the secret ballot in voting to unionize a company. Even a fool must realize that there is nothing free about having to give your vote in front of everyone else. An employee has to either sign a card or not. The secret ballot is the basis of all freedom in America, dude! Now we are calling being drafted, volunteering. I am trying to appeal to the Moderate and Liberal voters in America. Please, understand what is being done here! If the Republicans succeed you get more liberty. If the Democrats win you get less freedom. If Obama succeeds Americans loose. Obama must not be allowed to succeed. Obama must fail! *

Since you plan on hiring a lawyer for the custody, you might as well use that same lawyer for child support. Child support divisions are overloaded, you case may take years for them to even take a look at it.

Chances are, you don't have to hire an attorney.
Talk to the child support division of the attorney general's office.
You will need to give them all the information you can in order for them to deal with him.
Get ready to do battle with him for both current and back child support... and move on with your life as if you don't expect anything.

Here's a little something for you to read that may shed some light on your case-then you can go from there.

I would suggest actually calling whoever deals with these matters and make an appointment. Good luck.
