I was in the navy for 4 and 1/2 months then i was discharged becuase i cant hear high pitch freq. What should i do if my previous employer wont give me my job back?

I was in the navy for 4 and 1/2 months then i was discharged becuase i cant hear high pitch freq. What should i do if my previous employer wont give me my job back?They never tried to reclass me. Seems there is more here that you are not sharing with us. They should have reclassified you into another job that does not have the same hearing requirements that the one you had did. But that is not your question here.

Your old employer is under zero obligation to give you any job. You quit to enlist in the Navy. You were not and are not a Navy Reservist that was deployed. If that was the case, by law they have to hold your job for you.

Best bet is to go find a new job since your old employer seems a little pissed you quit on them in the first place. You may have problems getting another job since you will need to disclose what you have been doing between your last civilian job and now and most employers are going to be really shy about hiring anyone with 4.5 months of military service. There is almost always a lot more to the story than what you are disclosing. Just the facts of life here.

If you enlisted as active duty, not in the reserve, it is my understanding your previous employer does not have to give you your job back. When you left to join the military, you effectively gave notice as the military is a full time job. The only time an employer must give you back your job is if you entered the reserves/gaurds and were then activated to active duty status. In that case, your employer would have to return you to your job when your deployment was over and you returned to regular gaurd/reserve status.

they are not required to give you your job back. since you went AD, you are not covered under USERRA. That only covers Reservists while they are in training and called up to deploy.
