My girlfriend had a baby in dec 2006,I did not claim him because the paternity test did not come back till june 2007,what do I do? also should my company know about my new dependent,would it be better for take home money?

You can only claim that the baby is your dependent if the baby lives with you and you are financially taking care of him/her. If the baby lives with both parents, only one of them can claim him/her as a dependent.

If you aren't living together and your baby lives with your girlfriend, then she claims the baby as her dependent and you do not.

1. There is still time to file an amended 2006 return to claim the baby (if the baby was your dependent, and not your girlfriend's dependent) and receive the refund that you would have received if you had claimed the baby when you filed originally.
2. If the baby is your dependent, then you give your employer a new W-4, claiming one more than before, and your tax home pay increases. I do not recommend telling your employer that you got someone pregnant without marrying her, but that is up to you. You only need to do the W-4 to get the withholdings changed. You will need to give the employer the name of the baby (and your relationship to it) only if you want your employer's health insurance plan to cover it.
3. If the baby is your girlfriend's dependent, then it is not your dependent, and you cannot claim it on any tax forms, including the W-4 or the amended 2006 return.

Are you living together? If the baby lives with your girlfriend and not with you, then she is the one who can claim the baby - you can't unless she gives you permission in writing including a statement that she won't claim him. If she gives you that permission, then you could change your W-4 to include the baby as a dependent. If the child lives with you, and/or you all live together, then you don't need her permission to claim him. But only one of you is allowed to claim him for any given year - if you both try, the IRS will contact both of you to get it sorted out.

Stephanie's answer, by the way, is just full of misinformation.

if she claimed him last year you claim him this year. he can only be claimed by one person. you guys will have to come up with an arrangement, or see who can get to the tax guy first. if you claim him as a dependent it will get you a little more monthly, if not you will get a little more at tax time. it just depends on your preference. also some states wont let you claim your child if you dont have 50% or more custody. good luck
