can company i work for and have contrct saying i am entitiled to 20 days holiday now say it is mistake and taking days from me i have worked there for 3years

From 1st October 2007 you are entitled BY LAW to four weeks and four days.

Seriously...if you have a copy of the contract with your company (note spelling), check the clause(s) under "Vacation Entitlement." If you are a Unionised Employee, check with your Union Rep immediately.

The amount of Vacation Entitlement you have is black letter in most contracts. If you can produce your contract and it states that for your seniority level, you have 20 days owing, you win the argument. However, if you've since signed another contract that reads you have only 10 workdays (2 weeks) holidays, you're up the creek and paddleless.

In any case, no matter how it resolves, remember that if you have more than 2 weeks, you're better off than a large percentage of the working population in the "Western World."

Incidentally, if you are unionised, you can try the "Past Practice" card, but that can backfire, because they can then start using dirty-tricks on you to try to make you quit.

You need to take this up with the Labor Board in your state. If you have worked for a temporary staffing agency you must at least worked 1500 hours straight no time off before you are entitled to vacation pay or holiday pay. Check with the labor board in your state. Also contact the HR Manager and make an appoinment to go over you time and hours. If they are taking your time away from you in dollars from you current paycheck. LISTEN
Get on the phone and discuss this with the Equal opporutnity Commission. They said it was a mistake then they should rectify the mistake correctly. You need to be handling your business and start making some phone calls. Be discret if you are at work. Make sure you have all your pay stubs before you start discussing this matter. You want to be prepared and make note of everyone you talk to that is get there names, tile and department of where they work. That is important if this matter goes into a court battle. Seek you justice correctly. "So Handle your Buisness my friend"!!!!!

That is ILLEGAL.

Up until 30th September 2007 EVERY Full Time Employee was LEGALLY entitled to 20 PAID days holiday every 12 months PLUS the 8 Bank Holidays.

As from 1st October 2007 EVERY Full Time Employee is LEGALLY entitled to 24 PAID days holidays every 12 months PLUS the 8 Bank Holidays.

Do you have paperwork stating the 20 days holiday? If you
do then they can't but if its not in writing ...... they can take
it away and say they didn't offer holiday. Sucks, I hope you
get your holiday days. I mean after working there for 3 years
they shouldn't take it away from you.

if you have a vaklid contract they are obligated to pay you those days. It will depend on the jurisdiction where you work too, so the best answer would be to check with either the labor board or a lawyer.

This is wrong, if it was the company that made the mistake, then they should accept that.

HR dept should be held accountable for any error.

They are trying it on, to see if you accept the decision...take it to a higher level in the company.

Not only did you sign that contract but so did they, they cannot take these days from you. You should seek the advice of your Union or go and see a Lawyer or the Citizens' Advice Bureaux.

I would ask to see the contract and also you have a right to call the coporate office and have them explain to you what you are entitled to.

contact a lawyer immediately!! I don't believe they can take back what they already gave. All they can do is change your contract review it with you and you would have to sign the new one to validate it.
