Yes, you could be sued. You probably won't though, unless you're really flaunting it or really rich and worth suing. If you were rich though, you could just buy a legal copy.

No, not unless you admit to it and even then all they can do is demand payment for the product. realistically the worst that would happen is that you would be forced to either pay up or delete the Operating System. There are millions of people who use pirate copies but aren't aware of the fact because someone else installed it for them or they bought a used PC which already had a pirate copy on it.
Edit* even bad pirated copies can download security updates, they just can't update anything else.

It is a possibility you could be sued. If you are just using it you will probably have problems getting up grades as it is not a genuine version. If you are selling it the chances are you would be sued and it's not hard to catch people selling illegal copies.

I don't think that Microsoft will sue you, but you won't be able to download any of the security patches or service packs, so you'll be pretty vulnerable to internet attacks.
