I'm so nervous and don't know what to expect. I already have all my paperwork ready. The stuff they told me to bring. Can anyone tell me what to expect. And I'm a little confused....I looked on a website about Chapter 7 and 13, we qualify for a chapter 7 because we have 4 in the family and don't meet the monthly income requirements but then it said that if you can pay at least $110 a month then you have to file for chapter 13. Am I mis-understanding something here? Please help! Serious questions only Please!

Well, I feel that the reason we are filing bankruptcy is personal. That isn't part of my question! I just wanted to know what the first consitation will be like and to help with my nervousness!

Basically the lawyer will explain the differences between the two Chapters, and look over your paperwork. Since you have everything together this will give them a more accurate picture. They may ask the reason you are filing bankruptcy, and it would be up to you how detailed you feel you need to get.

The "means tests" you are talking about are not the final say in what you qualify for. There are several conditions as to what Chapter you can do. In addition to the means tests, this includes things such as the property you own and if you plan to keep things like your house or car.

Now, if you fail either of these two main tests you are not automatically forced into a Chapter 13, but other tests kick in to determine this. Since every case is unique it is impossible to say what they will recommend.

Now, the implications of bankruptcy will last for years. Because of this you should not just get one opinion. You need to see at least 2-3 lawyers. Then if you go forward with the bankruptcy go with the one you are most comfortable with.

I did a chapter 7 bk a few months ago. If you would like to email me about your questions at hansjill228@optonline.net, I will be more than happy to answer them. I have a lot of knowledge about this, but I don't want all of my personal info to be public knowledge. What I can tell you here and now is that it was the best thing for my family and myself. I can sleep at night now.

The lawyer will review your paperwork, talk to you about bankrupcy in general, and tell you what your options are and what you will probably qualify for, and what the effects will be. Have a list of questions ready, but let him or her talk first since if he or she is any good they might answer most of them without your asking - but at the end, if any aren't answered, ask them.

You do not say why you are filing BK, (like huge medical debt, credit card debt, etc) but make a list of your questions for the attorney. you're paying him the big bucks!!
