I go through her washing basket in her room sometimes and get some old used ones and sniff where it smells used. Is that legal? i wanna make sure and ill stop if it isnt legal.

The sniffing part isn't illegal, no. But, does she know you take them? If she hasn't given you permission, that is stealing and yes, stealing is a crime.
