Both are just as illegal, the punishment for possession has greater potential then ui. Drunk in public is just as illegal.

Under the influence only bites you generally if your causing a problem....like Driving or in public being a nausance. Other than that it shouldn't be problematic.
Possession bites you hard because its pretty much an open and shut case against you for just having something illegal, but if you have more than a certain amount (set by cities / states), they can nail you harder, with the ideology that you have too much for personal use and probably intend to distribute.

posession usually, unless operating a motor vehicle under the influence and /or causing an accident can be a felony in many states now.

Possession is pretty bad...but if you were piloting an airplane under the influence you should be given the Hoffa treatment.

Ok this is how the law goes possesion depends on how much of the substance you have all substances have a set limit then its intent to sell and much worse....then a DUI would be nothing compared to possesion and intent to sell...

Possession. More so if you have a large quantity, because then it become possession with intent to distribute, whether or not the intent was there.

You are either pregnant or you're not.
You either violated the law or you didn't.
The question is one of PENALTY not illegality.
