when a cop comes to a house party they arent legally aloud to come inside...because they dont have a warrant... most people make the mistake of allowing cops to come inside....legally you dont have to let them in....however, if you are over the age of 21 nothing can happen to you... your at you house and drinking in the privacy of your own home...the party might have end but you wont go to jail...most teenagers get busted....i am assuming your under 21 because why else would you be wanting to know the answer to this question...anyway the reason most parties get busted is because kids are stupid and cant hold their alcohol...and are really loud and obnoxious and do stupid things like yell at the top of their lungs at 3 am or blast music...be smart... if you are going to have a party be reasonable and dont go crazy and invite a zillion people... make sure you dont let people in you dont what there and keep control of the party....ps...be safe and dont let you friends drive home drunk....oh and another thing dont get too drunk because if the cops do come your the one who they will want to talk to.

Police respond to complaints from neighbors about a loud party. The government's peace cannot be disturbed. Meaning the police can't be disturbed by the loud party, a citizen must complain*
*The exception is if the police are enforcing a city/county ordinance against loud music, in that case the citizens of that community have voted a law into the books.
Usually parties are "open" meaning people move in and out without question. The police have the right to move in and out just like any other citizen. The surpreme court has ruled the police don't give up their rights as citizens simply because they put on a uniform.
We usually knock at the door and ask for a resident. If no resident answers, we generally enter to locate a resident. Usually partygoers don't know who's house it is, and therefore do not have permission to be there. They are usually told to leave. Once a resident is contacted, they are identified and usually given a warning to lower the music or party the first time. If the police are called back, they can be arrested or cited.
So, simply the police can enter the property once an attempt to locate a resident is unsuccessful at the door, and the loud music and talking makes it impossible to "shout" for the resident. Its reasonable that the officer can enter the main living area and try to find a resident.
By the way, once there any thing in plain sight is admissible in court.

The Police need probable cause or "extenuating circumstances" to enter a residence. Obviously if someone inside the home is screaming "HELP" thats extenuating circumstances or If officers see beer or alcohol in the residence and they know an under aged person has been drinking or if an under aged person answers the door and has alcohol on their breath, they then have probable cause to enter, but many of the old timer's still won't enter unless they are invited in or they have a warrant. Rookies will though since they have'nt had the chance to waste the courts time and had their asses reamed by the Judge or States Attorney because their cases lacked probable cause and were thrown out. Usually how it works is some drunk kid answers the door and when the Officers ask "You don't mind if we take a look inside do you? The drunken idiot that doesn't even live there but was partying down there says; "Uh, Umm Gee, Uh Yeah, I giss so Ossifer" and lets the Officers in.

As a retired police officer this is what I did. Note: we had to be dispatched to noise complaints we did not start the call.
Most parties people party outside and inside of the house. If they did that on public property (sidewalks) we would issue them a code violation for open intox. If they looked very young we would ask them for ID. If not 21 we would ticket them for that. You can go up to the home and make contact with the owner/or person on the lease. If it was to loud we would issue a ticket for that. If any cars were parked illegally we would tow them. After all that the parties usually broke up.
Note if the no one called on the party I did not care. We did this when the people in the neighborhood called to complain. It was a college town. We had many many over the course of a night.
If the owner / tenant did not answer the door and the music was to loud we would get a search warrant. With the search warrant you can legally enter the home.

Most the parties I been in that got busted because we got people drinking all over the front yard and on the street =) If you are goign to throw a party make sure it doesn't get out of hand! But s easier say than done when you got 20 drink dus in your house

If under age people are drinking, that is a crime and they can enter the premises. Also, someone usually calls 911 to report a fight or other crime in progress or threat to public safety therby giving the cops probable cause to enter a house.

All the police need is probable cause(meaning something harmful or illegal going on) and they can enter a premises- such as underage drinking...etc. If they dont have good enough probable cause..it will come out in court and get thrown out. If they do and people get busted..well...

I don't know about where you live, but here in Ontario, if the door is open, they can apparently walk right in, or at least I have seen it happen more then once. otherwise, it won't happen unless someone tells them they can enter the premises.
