As a police officer, I want to say "thank you" for making a smart decision and sleeping in your car. I would much rather deal with that, then take do an DUI accident investigation with a death.

I love arresting DUI's. Why? Because no other crime hurts so many people over something so stupid. Hundreds of wifes, husbands, friends, brothers, sisters, and co-workers will die this year because some idiot decides to drive after drinking. I love taking that person to jail.

If you have not heard of her, read her story and pass it along. This is a result of a DUI. Jacqui didn't die. She lives scarred forever because of a dumb choice.

Please, please, please get a desigated driver, take a cab, go to sleep. DON'T DRIVE. If so, there are plenty of officers like me who will take you to jail. We do it not to be mean, but because brave women like Jacqui have been harmed because of your decision.

Some Officers would arrest you if you had "Dominion and control" over the vehicle and the keys were "readily accessible." This is well within their rights in MOST States, I'm not sure if it is like that in ALL states. However, I have given numerous people "courtesy rides" home from the bar after being asked.....BUT WE ARE NOT TAXICABS, calls permitting, I have absolutely NO PROBLEM giving someone a ride home, when in need. Keep that in mind next time, I can't promise that your local PD will give you a ride home, but I KNOW that I have...and will continue to do so until I am told that I can no longer do it.

In my state you would be arrested for driving under the influence (DUI). They don't give a break on being passed out in your back seat. Who cares the keys are in the glove box, as long as you had access to them you could suddenly grab them and then drive down the street like a drunken terror. It's best for you to have the people who served you alcohol to call for your cab - or sleep inside. If I slept in my car - my back would be so screwed up I would probably have to miss work the next day anyway.

Best chance is to not have the keys on you and to keep them under a seat or in the trunk
if you tell a police officer that you/your friend hide the keys from you to stop you from drinking and driving they're most likely to let you off the hook

IF YOU SLEEP IN YOUR CAR AND THE OFFICER WAKES YOU AND YOU SMELL OF BOOZE, HE HAS A PROBABLE CAUSE TO ARREST FOR BEING DRUNK.(P.I. /PUI,DUI)?

WHAT IF YOU HAD GOTTEN UP AND DROVE OFF OR HE LETS YOU GO AND THEN YOU HAVE AN ACCIDENT.

IF YOUR GOING TO DRINK DO NOT DRIVE OR GET A DESIGNATED DRIVER.

IT DOES NOT MATTER WHERE YOUR CAR KEYS ARE. THE FACT THAT YOU ARE DRUNK AND WE NOW KNOW IT LEAVES THE QUESTION OF HOW FAR DID YOU DRIVE DRUNK?

IF YOU LOCK YOUR CAR UP AND THEN I LET YOU STAY AND GO BACK TO SLEEP. WHAT HAPPENS IF SOMEONE ELSE COMES ALONG AND KILLS YOU AND TAKES YOUR CAR?

If you have access at all to the keys, you can be arrested. You could be charged with being in physical control while under the influence.

You should be allowed to nap in your car drunk if your jeys are not with you. What has the world come to?

As long as you have control of the vehicle, you can be arrested. If the keys are anywhere where you can get to them, you have control.
Call a cab and go home.

The previous poster is right. My husband was passed out in his truck and the keys were on the floorboard and they got him b/c at any moment he could have awoke and drove right on home-drunk.
