This is a question for my friend, she was pulled over last night because of a broken tail light on her very drunk friends car, she was taking him him, and the cop pulled her( for the broken tail light) he then asked her if she had been drinking, and she told him.2 glasses of wine, mixed with lemonade.
He said she was looking at loosing her driving licence, is this possible???
Help- quick please cause she is going nuts with worry

Ok- Just found out that she didnt have a breathalizer or anything. Its just verbal what he said to her- its her word against the cop I feel.
If there wasnt a test, how can they take her licence.

Yes, it could be possible that your friend was over the legal limit for driving. At any one moment in time the level of alcohol in you blood/urine or breath depends on many factors.

The first is how much alcohol the person has actually consumed. You say your friend had 2 glasses, but that could mean small glasses of very large glasses.

Secondly, it depends on the alcoholic strength of the wine. This can vary from about 9 % but can be as high as ~14%.

The lemonade would have little effect. It dilutes the wine but your friend would have still consumed the same amolunt of alcohol. However, because it makes the drink fizzy this can increase the rate at which the alcohol is absorbed from the stomach.

Other factors that determine the alcohol level include whether or not your friend had or was eating, their body weigth and how quickly their body breaks down alcohol once it was absorbed.

If you friend was positive on a roadside breath test then that indicates that they were over the legal limit at that time. However, this is only an indication and to be charge with being over the legal limit a person must be taken back to a police station and provide a sample of breath in to a more sophisticated measuring machine or provide a blood/urine sample.

The results of this test are the ones that would be used to bring a charge.

What amount of alcohol could put one person over the limit could be different for someone else. We are all different.

I would assume you friend was subject of a breath screening test at roadside. If she failed then she would be arrested and taken to a police station where she would provide two further samples of breath for an evidential test. Only then would you know if she was over the limit. If she was under the limit she would be allowed to go. If she was over she would be detained until sober, charged and bailed to court.

If she passed the breath screening test at roadside she would be allowed on her way . I can only presume that she passed the test and the officer was warning her of the perils of mixing drinking and driving, i.e if you are caught drinking and driving (obviously over the limit) you will lose your licence.

The answer depends on a sobriety test. She could either be tested on the spot, using a breatholyzer or be asked to do something like walk a line or say the alphabet backwards, but the only way to know her BAC or blood alcohol content is to have her take a blood test. If the blood test was over the limit, she will have problems, if not or if she was not given a blood test, she will probably not be charged.

She could have been arrested under the old procedure (e.g. if the officer didn't have a breath test kit with him). If that was not done, no action is being taken. The officer was probably giving her a warning to be very careful in future because she has no way of knowing whether she is over the limit.

Did he breathalise her? she would know if she was over if he did, and if he didn't then she has nothing to worry about because he has no proof either way.
As it goes I would very much doubt she was over any way unless she is tiny and hadn't eaten anything.

Driving after one drink, although it might be legal, is still stupid. It depends on how much wine there was and how big of a girl she is.

In the UK she will have to be tested, thats it!, in the US i dont know, so if your in the UK, then nothing to worry about at this stage.
