It was there fault and i have a torn meniscus in my knee from the accident. But, I dont have a job. How much money would i look to recieve? i have a lawer and I am going to need knee surgury. Could i opt for a buy out and if i did how much money do you think i could get? But, I really would like my knee fixed.

Is there a police report that states it is their fault? I think that's the first thing you need, otherwise it turns into an "I said, you said" thing.

If there's proof it's their fault, do they have insurance? I think a claim would be filed against their insurance first before you decide to start suing.

That's hardly worth suing over. It is not a disabling injury. You're entitled to recover the cost of your medical care and maybe a couple grand for pain and suffering. If you're looking for a windfall, forget it.

There's so little money involved here that it's hardly worth a lawsuit. If you press the issue (and can even find an attorney willing to take it to court) expect it to take several years to settle. And expect most of any award that you get to go to your attorney.

has the other parties insurance company excepted liability? if so, then they will pay for your medical care to fix your knee, damage to your auto, a rental until yours is fixed, and maybe a little on pain and suffering. if you were not working before the accident you can't claim lost wages because you don't have any.
if they have insurance theres no need to sue them, their insurance will cover you. if they don't have insurance then i would sue for the cost of medical etc... if you're looking to get rich off this, its not gonna happen, especially if they have insurance. insurance companies are NOT scared of your lawyer.

If you have a lawyer -ask him.

His fee will be 1/3 of your settlement so let him do something to earn it.

You hired the lawyer to handle the claim for you - that includes providing legal advice. You will be paying him a large chunk of your settlement for his advice so ask him since you are paying him.
