have been to dealership 5 x, can't "duplicate" the problem although an employee was in the vehicle once when it happened. This is dangerous pulling into traffic etc.
Anyone else had this issue?

If an employee was in the car they saw it happen.

I'd talk to the dealership and let them know you will be invoking the lemon law if they don't solve your problem.

Also contact a lawyer about the problem, and see if there's anything that can be done. Lemon laws require that a new car be repaired, and the service department is given 3 attempts at repairing it.

I had it happen once in my cherokee but it was stuck in 4-low. I worked at a jeep dealership and commanders are pretty good vehicles. I'd go to a different dealership. And if they can't duplicate the problem then they don't know what it could be. And start thinking about swapping it out. Commanders are EXPENSIVE...get with the sales manager and I guarentee something will be done. They don't like to hear people having problems with HIGH END cars! We had someone in the same situation with his 300C, but they couldn't determine the problem so they swapped it out for him!

Yeah, you need to demand that they look into this further. Don't put your life and others lives at risk because they can't duplicate it. If the dealership won't listen to you, call Chrysler. I'll bet they 'd be a bit quicker to understand the cost savings of repairing/replacing your Commander over a wrongful death lawsuit. Good luck, I'd love to hear what becomes of this.
