My ex is $4000 in arrears on child support for our little girl, this is a year of not paying. He had a court date on Wednesday and did not appear because the police were not able to serve him with the court papers because he moved from his residence. He did not report his new address to child support either. They called me and told me they were having a bench warrant issued. Child support tried to call him at his mom's number which I gave her. This was his last chance. His mom lied and said she didn't know where he was. So now that the warrant has been issued, what will happen? Will the police go to his house? They know where he lives. Or will they just wait and pick him up if he gets stopped for a traffic violation? He also has his DL revoked due to 2 owi's and 1 driving after rev after the second owi. Please answer, I live in WI if anyone knows WI law. Thanks.

As someone who has worked with constables (the people who serve most bench warrants) I can tell you that the chances are they will not go after him directly. Constables often go after the people who have multiple warrants (more then three or so) because they are paid per warrant the person is worth. If your ex shows up at court at another time, or is arrested by police for whatever reason he will then be served with the bench warrant. Bottom line, don't count on the authorities to track your ex husband down over one warrant unless he comes across the path of a police officer/constable and is an easy pickup.

Depending on where in WI you are, some agencies have officers that look for people residing in their jurisdiction with warrants but nevermind, noone knows where he lives... If he has been hooked for 2 OWIs, he will again. Its just a matter of time. Once he is arrested for the OWI and warrant, he will see the judge. Unfortunately, as far as the child support, he will only have to supply a current address and a financial disclosure statement assuming this is his first failure to support issue. After repeated failure to support issues, he may be jailed.

It's all a process dear, he will get his day in court. Yes when it's time the police will pay him a visit in order to serve the warrant. If he brakes the law and gets caught the warrant will show up and they going to keep him till he sees the judge. If a cop stops him for any reason and run a back ground check on him he will be arrested for the warrant because it's going to show up.

The problem with bench warrants is they are not actively pursued. Usually, most people are arrested when picked up for something else. Most States will have already placed an order of garnishment for income tax returns during this time. When I worked in Florida, I saw the Sheriffs department serve many warrants at the plant I was employed at. If you know where he is working, you can give this info to them.

He will be arrested he may not even get a court date he can be tried in absentia, he needs to go face the music before he becomes a felon.
