you bet people with mental illness have to disclose this so it can be used against them its kind of like asking for your race . if you put down you have been in the hospital for a nervous breakdown you are screwed

Dismissing a person with mental illness is the same as dismissing a person who has any other illness, such as cancer, diabetes, or hypertension. You wouldn't disclose them, would you?
It is against the law for an employer to enquire about your health history. The only time you should tell them is if modifications to the work environment need to be made.

How would they find out if you did not disclose it? I believe they cannot (unless it is a government job -police, etc.maybe?-not sure) because it is a different level of confidentiality when it comes to HIV/AIDS disclosure, mental illness/psych history, and also substance abuse...

If the application asks for that info and you haven't disclosed it then you can be dismissed for falsifying your application.
