My son get hit by a taxi from behind. He was approaching two line highway where speed limit is 40 mph. He already made his safe turn after checking traffic from left and went almost 30 ft after stop sign. Taxi was in left lane of the highway and hit him from back. Taxi front left was damage, both airbags both inflated. My son's 199 pontiac montana minivan rear left tail light damage, and tail gate damage. Rear bumper was thrown from left to right side of the road.

Cop gave him ticket instead of taxi, that he did not stop at stop sign and failed to stop and yeild to incoming traffic.

I can't understand, why did he get ticket, when he already passed the stop sign, after checking traffic properly, no one on his right lane from far left. Taxi was coming from far in left lane. My son turned in right lane. When taxi did unsafe lane change at last moment, by not paying attention on raod and no tire markes on the road which says he did not apply brake at all.

Take pictures, and have any possible witness statements available, and go to court. Looks like the taxi was in the wrong, by either improperly changing lanes, or changing lanes in an intersection (yes, that is illegal.) Take it to court, and bring lots of pictures, and statements. 30 feet isn't that large of a distance, but it does show that the cab was changing lanes in an intersection/shortly thereafter, due to the left side of the van being damaged, and right side of the taxi. (you did say left front of taxi, which doesn't make sense/wouldn't be possible unless the taxi was at an askew angle to the roadway, so I am going to assume you meant right/passenger side.) If your son had pulled out in error, then the cab would have t-boned him, or would have had complete front end damage.

If it's illegal to make a lane change while going through the intersection (is it?), then the cab is at fault, I'd think. Besides, you'd think the driver would have seen your son pulling out!

I don't trust people not to pull that move on me, so even if someone is in the left lane when I'm about to turn into the right lane, I wait for them to go by.

I would say it depends on what your son SAID at the time of the accident. Typically the driver is responsible for the road in front of them, not behind them. He may have told the officer something different then what he told you. I would start by a call to the officer and see what he says.

Any time you hit another vehicle from behind you are automatically at fault the police told me. Really they do what they want.

Make sure you go to court and fight it because if you don't it will go as an at fault accident on your insurance. That will cost you.
