The D.A only has 1 year to file charges in this case if the bag was empty they would only be able to charge you with possesion of paraphernalia depending on the amount left in the baggie.

Nothing illegal about an empty bag.
Now if the bag had a residue of something illegal in it, and they took a sample, or the bag itself, then yes.
Otherwise not much they can do....except frame you of course...because there is something fishy about a person iwth an empty bag in their mouth while driving.

they'll want to have a look at the bag first and if they find certain things in there like drugs or whatever or traces of it then yeah they can
