When my bipolar xwife and I were seperated she told me to come to her work. When I showed up she had left and told police she was in fear for her life. I never did anything to her ever. Several police were waiting for me. I told them I would leave. I put my hand inmy pockets to leave. They thought I had a weapon. I did not. 1 officer hurt his shoulder when he tazered me. I was charged with felony assault and put in jail for 5 months. Now I have 3 years probation and my probation officer said even if I am in another state and my x wife calls the police and says she thinks she saw me I can go back to jail. I have no desire to contact her but i would like to see my son. Please help me I am scared to death to even walk out of my house. Again I had no weapon, no drugs, no previous record and never ever harmed my x wife. She wasn't even thee. She just imagined it.

You have rights to see your child.

However, you need an intermediary to deal with your ex.

This would be a good place to use an attorney.

If you spent 5 months in jail, some of your behavior didn't seem as innocent as what you've written.

I would suggest you never have any contact with you ex at all.
All communications should be through your attorney.


Restraining orders have time limits, (1-3 years, usually).

If you ever see your ex, run the other way, (or, if you're with friends, stand still, refuse to talk to or look at her, if there's a question later, you have witnesses).

That is NOT true that you can go back to jail if you are in another state, and she calls the cops. There is something in the country call "alibi" and if you can show you are in a different state then she can not do anything, nor can the police. I would also report this probation officer to his or her superiors. They can not male statements like that, especially when they are not true!

Did you get a legal aid attorney?

She may or may not have imagined that you were a threat to her, however several police officers who are trained and less likely to be afraid of a passive person also felt threatened. "I t my hand in my pockets to leave." - Why would you do that? You can leave without your hands in your pocket.

Since you are a convicted felon and your conviction is for a violent act, you will not get the retraining order lifted, particularly since you refuse to accept ANY responsibility for what happened.

If you want visitation, you need to petition the court. While it is highly unlikely that you will get unsupervised overnight visitation, visitation can be provided. In order to comply with the restraining order, the visit would be supervised by a trusted third part.

You need to consult an attorney, and work with him to 1. Try to prove that you are NOT in fact a danger to your x-wife, and prove that her bipolar ism is the cause of your jail time. You may be able to get $ for damages on that one also. Secondly, you have rights as a father, and can try to share custody of your son, or setup proper visitation rights. Best of luck to you, all this MUST go through the courts, so get yourself a GREAT attorney, and fight for your rights!

Only way to do it is to go back to court. Your PO is over stating something that would need to be proved if you are not even in the same State as the day she said she saw you. I am thinking we are not getting all of the story here.

That's fucked up dude ...You might wanna consider a lawsuit against your wife.
