Ohio recently outlawed these machines
Local law enforcement officials will take action against the gambling game Tic Tac Fruit following Attorney General Jim Petro's legal directive.
"These machines are programmed to guarantee a minimum rate of return for the operator regardless of a player's skill," Petro said. "Ohio law prohibits schemes of chance, which is exactly what these games are," he said.

They should have a gambling license if they have gambling machines on site. And they should also have the license display some where on site
If not they are operating illegally and can be fined and closed down ,if authorities are told about the machines

Laws vary from state to state however, if it is a Native American Indian business on Tribal land, it's legal if they have a compact with the state. Tribal lands are sovereign nations, they have their own rules. If you live in a state that allows gambling statewide (like Nevada) then it's legal. Hope this helps.

it would depend on where the business was located..you left out some details here that are needed to answer this question. I live in Nevada and we have "gambling machines" as you put it everywhere, grocery stores, gas stations, 7-11 etc. and it's completely legal

Business have those in there for "entertainment". Often though, you can get store credit for your cash outs and if you get to know the people then you just win money.
