my brother inlaw has been living with us for over a year , we own our house , has he got any wright`s to my and my husbands property by law to stay on if i wont him to leave or if any think happend to any one or both of us ,has he got wright`s, were do i stand .

oh sorry about the spelling ? my brother in law is only using my address as a base , so address only for I D , but it is still on paper , i wont him to find some were els, wot iam saying is do`s he have the RIGHT to say to me NO and can he get loan`s and stuff even though it`s not his house , i have three kids not at home and i live in ENGLAND

If he's had no financial input in the house, then no, he has no RIGHTS.
If he's contributed towards the mortgage etc, there might be complications. Seek legal advice if in doubt.

Since what you're asking about is the law, why don't you post this in the Law category (in Politics and Government)?

The word is 'rights' and you 'want' him to leave.

Explain whether he pays.

Do you or your husband have wills? If not, you should.

Do you and your husband both own the house?

I'm guessing, but, when a man is married, I don't think his sibling are automatically heirs of his; the wife and any children would be.

But there are people in the Law category who know the law.

Also, say what country and state you live in, as laws vary.

As for the bro-in-law leaving, how does your husband feel about it? If he doesn't agree, that's probably your biggest problem.

He may have. Call legal aid society in your area who would know the state law. Has he been paying rent? But meanwhile, gather up all the money you can possibly spare and tell your brother in law ( after discussing with your husband and telling him that you feel your marriage is in jeopardy if this continues) that you will pay for his first night in a motel and help him move his stuff over there. After that he is on his OWN. I do hope your husband will be fine with it.

Go and see your local Citizen's Advise Bureau. A few years ago I was in a similar position and I was told to give him three months written notice, and then evict him. I don't know if the law has changed. I cna't see any reason why he should have rights to your property, but go and get some professional advice.

If you do not want your brother in law to live with you, let him know that he really needs to find a place of his own, and give him a reasonable time limit to do so.

When we take family in, we are asking for problems.. believe me... especially when there are no discussions or limits set BEFORE they move in.

It's your house.

He would considered a tenant, and if you want him out you have to have him legally evicted, with a proper 30 day notice. And it is just stupid not to have a will that states what happens to your belongs and property if something happens to one or both of you. With out a will every thing can end up in probate.

if he is not listed on a lease or he dose not have any written agreement with you and is not listed as anything on your mortgage then he has no rights to be there if you do not want him there. put something in writing and ask him to leave if you want to be nice give him 30 days if you have it in writing then it is legal contract. living with in-laws is HARD Good luck getting him out.

And number two...your brother in law has no RIGHTS to what you and your husband own.
