All rear end collisions are the fault of the person in the rear. Normally a ticket can be issued for following to close. If there is a three or more car accident and the person at the very rear caused the car in front of them to hit the next car the person who "caused" the accident in the very rear would be liable for repairs to all vehicles involved. Rule of thumb is leave one car length for every ten miles per hour or at least a 6 - 8 second space cushion between you and the car in front of you. Hope this helps

Usually. If the brake lights of the vehicle in front were not working, so you did not know it was stopping, that might be a defense. But as a general rule:
1) If you were too close to stop, then you were following too closely
2) If you were far enough back that you should have been able to stop, but could not because of something to do with your reaction time, brakes, tires, not paying attention, etc., that is also your fault.

Yep. I rear-ended a guy who slammed on his brakes on the freeway while talking on this cell phone, we were both doing 70 bounced off each other and then pulled over. I knew even though he was the dumba** I would get the ticket so I gave him the scolding of his life for 20 minutes until the cops arrived. He was in his 40's and I was in my 20's.

it is always the fault of the driver in the rear. It is assumed that the person in the rear did not leave enough room in between the cars to allow for whatever stupidity is peformed by the person in front of them.
Sorry for your bad luck.

Just about the only time you can beat it is when the front car has inop stop lights, but even THEN, if you are following at a safe distance, you can avoid a collision.

Yes unless you can prove the other driver did it deliberately. Common insurance rip off scam called the swoop and squat.
The car will pass you switch lanes and slam on the brakes. Usually it's loaded with passengers who'll all claim whiplash. They all go and see a crooked chiropractor who submits phony claims to your insurance company who's forced to pay off big time.
