I called the cops, he had time to flee. He has now told the detective in charge that i scratched him, and this is why he pushed me? Can he really get away with lying over this. The officers at the scene took pictures of me, a door he punched, and my cell phone which he threw on the floor and broke. Any advice on ehat will happen next?

He has two other arrests in his records. One of which its a felony for grand theft. and the other marijuana possesion. I'm not afraid of the outcome, because i know it will go in my favor. Due to the fact I am not lying, and have proof. I'm also trying to get a permanent restraining order, because he has left me numerous voicemails. i was just wondering if i can use these voicemails against him in court aswell?

Sounds crazy, but this sounds like a case I dealt with in Florida about a month ago. I doubt its the same incident, because we arrested the guy at a bar a week later. Anyways, you should be covered because of the pictures, and the fact that he fled prior to the Officers arrivals didn't help his cause. The only issue is we have to PROVE that he knew you were pregnant when he pushed you....otherwise, there is no agg battery......

Depends on the exact state law, but Florida and Texas are pretty close, so I will tell you what would probably happen in Texas.

He will have a chance to tell his side of the story to the detective in charge, if he refuses to speak with them,hold his appointments, or the detective finds probable cause he will then issue a warrant for his arrest. As far as the charge, if he just pushed you it is NOT an aggravated assault, it will be more likely an assault with bodily injury family member.

He will have an arrest warrant issued at large, which means he is not there and they will have to find him. If I were you I would go file for an emergency protective order to keep this creep away from you, the next time he gets his hands on you he will probably kill you or the baby god forbid. I would also probably invest in a handgun license, and the next time he decides to kick or bang on your door and puts you in fear for your life, put three rounds in his chest.

as far as you scratching him, as far as you know it was an accident that happened on your way to the ground trying to brace yourself in the fall. Good Luck....

Here's the deal: You have proof of what he did. The police took pictures of you, the door, and the cell phone, right? That'll go a long way toward convincing a judge he did what you said he did. If he claims that you scratched him and doesn't offer any proof (like pictures of himself with scratches) it'll be your word against his, and a judge will be less likely to believe him based on the damage he did to your house and phone, not to mention his assault on you. So don't worry about it. Just tell the judge the truth.

For one get a P.P.O against him. If he is violent now what is he gonna be like when that baby gets here.Did he have a scratch on him ? If the police are smart they will be able to tell if its a human made scratch or some other object.
Take him to court over the damages. Show him that you arent gonna take his abuse

Well since you did report this charges should be filed already. You should also have a restraining order. DON'T play games with this. IF you don't get one or keep one in effect then it does in a way reflect on you as credibility.DUMP this loser boyfriend of yours. You can do better. A real MAN NEVER raises his hand to a woman.

Been through this with my daughter.Its his word against yours.They collect all evidence and then take pics on both sides if you scratched him they pics of that.Then compare and see who did wrong.In the state of florida one of you has to be arrested.I am pretty sure in the state of florida one of you has to be arrested for the assult.SO,one of you will have warrant out soon for your arrest.
On daughters friend they waited til she had the baby to take her in.

Offer to take a lie detector test. Challenge him to do the same.
