First...you seem to think that a DUI breath/blood test will reveal the levels of the prescription in your system...WRONG!
DUI breath/blood tests reveal the alcohol content within your system.
In others words...there won't be any connection between the .03bac and the prescription you take.
Possession of prescriptions outside their containers is a violation of federal and not necessarily state law. Most state law enforcement will not prosecute cases where an individual has a legitimate prescription for a particular medication.
If you don't have a legitimate prescription for the medication you possessed...then you could be prosecuted for Unlawful Possession of a Controlled Substance.
Public Defenders are often times attorneys selected from a pool of local attorneys who normally practise in their private firms. Despite where the attorney normally practises...they ALL still have to pass their state bar examination.
If you obtain the services of a PD and are not comfortable with that attorney, you can tell the court you request a different attorney more suitable to your issue.

You blew a .034 or a .34? This being as a .34 IS serious. But a .034 is NOT even legally intoxicated in Massachusetts. But either way, you get what you pay for.

I would use an attorney...even though it sounds like a stupid case you could really get screwed posessing prescription drugs in unmarked containers. You don't want a public defender just blowing off your case because it is one of 100 he has that day.

On something simple, public defenders aren't bad. People like to bash them, but they are generally fairly smart guys who are paid a pretty good wage. They are in the court house every day (most other lawyers are not), they work closely with the prosecutor, see the judge every day, ect.

You don't have a choice. You will only be assigned a Public Defender if you can show that you are financially unable to retain an attorney.
