Thats pretty dumb if anything he should block the holes when they all leave at night to feed. And heartless though I am I would probably wait for spring to do so. When finding a new home wouldnt be that traumatic.

Your landlord should really have called animal control for this, but...

Blocking all exits EXCEPT the largest one is fine. For the remaining largest one, your landlord should install a one-way exit, so that the bats can leave (they'll go out at night to catch food), but then cannot re-enter and so will have to go and find a new home. That way, they won't get stuck up in there and die/rot/smell up the place, and attract other critters (like insects)...

Bats help to control the local mosquito (and other insects) population, and help to pollinate flowers, and should be encouraged to live in your area. However, if they have been acting wierd, then animal control should be called in to capture them and check that they are not carrying rabies.

One of 8 species of bats living in NY is the Indiana Bat, which is an endangered species http://www.dec.ny.gov/animals/6972.html , while the small-footed bat is listed as a species of concern http://www.dec.ny.gov/animals/7494.html .

Unfortunately, bats aren't listed explicitly as to whether or not a license is needed to kill/remove them or not in NY:

(In some states, like AZ, all bats are protected...)

The suggestion from the NY state Department of Environmental Conservation is to contact a licensed wildlife nuissance control operator, as listed in the yellowpages under "pest control services," or otherwise contact your local regional wildlife office.

Bats are not protected. There is nothing you can do if you do not own the building.

that IS stupid, as long as bugs can get in, the bats can feed and breed and/or canabalize. It's better to smoke them out.
