My son and his girlfriend have had a baby and all through the pregnancy she maintained that she baby would take our surname, then after the birth she changed her mind and the baby is registered in hers, that tells me that she has no intention of remaining in a relationship with my son. However should they marry at a later date, then they can send off the birth certificate and get the name changed. My son is registered on the certificate as her Father.

Mum has the right. Mum can register the birth without dad being there if she doesn't want him on the birth certificate but surely if you are still together it is better to work out a compromise. Personally I think it's better if a child has there father's surname but this is only what I did when my ex and I had our daughter.

It's up to the mother what surname the baby gets, either hers or the fathers!
If your the dad, and the mums said the baby can have your surname, then you have to go with her to register the birth!

Ultimately the mother, however, depending on state laws and procedures, the father can change the child's name, fight for custody, etc. I think it's better to give the child the father's last name, but I also don't know the situation.
In most cases the mother completes the paperwork, giving the child what ever name she decided. In some states you have up to thirty days to make any necessary corrections without charge. If a man wanted to get a rushed paternity test to prove his legitamate child, he could take that proof and make the corrections himself, but ultimately the decision rests in who ever has legal custody, that being in any state.

In most states that I know of the mother has the right to give the last name and it really doesn't have to be either of the surnames, it can be any last name they want really. But if its that big of a deal to both parents why not compromise. You could use both names. My youngest son has both mine and his father's last name.

The mother is the legal guardian when parents are not married so she has the final say.
My advice; dont push the issue she may go to the registry office and not bother naming you on the certificate at all.
When my son was born I wasn't with his father. I wanted my son to have my name. I asked his dad to come to the registry office with us and his surname is one of my sons middle names. No hassle.
Don't push her if she doesn't want it, you may push her right out of your life. Compromise.

Mom does, if the couple are unmarried by law the mom has full legal rights to the child's name. The sperm Donner has no rights to any such thing.
Even he wants to take you to court over it saying that he has every right to have the baby's last name be his. HE WILL LOOSE. The only time the man has any right at all is if he marries the mommy. Then even then she still has the right to have the child be under her name. Which is unlikely.
