I was summoned in Oct. for the month of Nov. I told my employer this and he asked me to get out of it. A couple days later I told him I would have to wait until my first appearance in order to try to postpone it for a later date. End of Oct. comes around and they fire me. I think my rights are being violated, just not sure how to prove it in court.

I have never had any disciplinary action against me or any warnings of any kind. I have never been tardy and I have been employed there for 15 months.

No, you can't be fired due to jury duty. However, you are likely an at-will employee, which means you may be dismissed at any time without reason. The burden of proof will be on you to show that you were fired b/c of the jury duty. I'd mention something when you report to jury duty.

Not in the United States in fact US Military will release their people for jury duty unless they are vital to a particular mission. One must of course be responsible and inform their employer that they have been called for jury duty. You cannot disappear for a week of jury duty then show up and expect to have your job still waiting unless you have done so.

They cannot fire you for doing jury duty. They may request that you give the money you get paid for jury duty, to the employer if you want them to continue paying your regular wage, (that is normal practice) but they certainly can't fire you.

Go to jury duty and tell the judge that your employer refuses to let you do jury duty and that he has already fired you.

Totally illegal. First of all i would do an internet search on this, print out all the info you need and then go to your employers and show them. If they still will not budge, on to the citizens advice bureau and see where you can take it from there. Good luck

Hi Cybertoo. No this is illegal your employer cannot fire you because you are call for jury duty. If he has report him and he will get into trouble and you will get your job back if you want it.

go to jury duty and tell the Judge what happened, it is a federal statute that you can not be terminated for jury duty.

illegal i think even the right to work states meaning states that can fire you for any reason, cant fire you for this. call the heavy hittter!
