Without knowming more information about you personally, it is difficult to say. It can go either way...

Here are a few quotes from the SSA regarding this situation (the link is below):

A person can receive benefits as a divorced spouse on a former spouse’s Social Security record if he or she:

- was married to the former spouse for at least 10 years;
- is at least age 62 years old;
- is unmarried;
- is not entitled to a higher Social Security benefit on his or her own record.

(NOTE THE UNMARRIED STIPULATION, but as with any government agency, nothing is simple....)

If the surviving divorced spouse age 60 or over applying for benefits remarried after age 60, or after age 50 and at the time of remarriage was entitled to disability benefits, the marriage is disregarded. If a person is already entitled to benefits as an aged or disabled surviving divorced spouse and remarries, benefits continue regardless of the person's age at the time of remarriage.

So the answer is maybe, maybe not. It depends on specific details of your situation

Yes, and you should since you will have your new husband's income to live on. SS isn't there to pad the wallets of people, it is there to help them survive and the elderly don't get near what they should because of people who work schemes to take money from the system when they don't deserve it.

If your ex-husband is living—
If you are divorced, you can receive benefits based on your ex-husband’s work if—

Your marriage lasted 10 years or longer;
You are unmarried;
You are age 62 or older;
The benefit you are entitled to receive based on your own work is less than the benefits you would receive on your husband’s work; and
Your ex-husband is entitled to Social Security
retirement or disability benefits.

My husband has told me many times that after he dies, I should choose his SS over my own, as the benefits are better.

And, he has told me not to get married again, so I won't lose his SS. I can live with someone, but not marry. (Not that I would. Too hard to "break another guy in")

So I think yeah, you'd lose your ex's money if you marry.

Call the SS office and ask.

Yes I do believe so. When you marry someone else you will be entitled to their benefits after they pass on. My grandmother lives in California and has has three husbands that died and this is the way it was for her. I guess laws could be different in other states, but I wouldn't count on it.

I would believe so, however, this is a question best put to an attorney. It would be worth the money to investigate that further. However, if you are contemplating taking the plunge again, dont let that affect your decision.
My ex wont marry her new partner (who I hear is loaded) as she will lose financial aid for our daughter who is attending a prep school.

Phone Social Security office and ask them. It is not the same for everyone.

If you are married to the new one longer than 10 years and he makes more money than the ex...you will get from SSI the larger
amount. No, you technically won't lose the benefits
BUT...if your ex was disabled vet collecting now, you would lose the money you get now.

Yup.

I'm curious - How do you collect benefits from an EX anyway?

All cases are independant.
If a widow, see SS admin.
If divorced, depends on your agreed entitlement.
