i ride with my friend a lot and she has alcohol in the trunk of her car. I don't drink and have never drank but she does. We are both underage. if we were to get stopped and checked, would we both get in trouble even if the alcohol wasn't mine and i was not driving? I just want to make sure, because there is a law in sc that states that if the persons in the vehicle are riding in the car with possession of alcohol we all get fined.
PS: i've never seen it and i don't drink it i just know its in the trunk of her car and i ride with her all the time.

So according to NC state law is it ok to have possession of alcohol in the trunk of the car while as a passenger while underage?

First off, you assume the alcohol is in the trunk because that is what your friend told you. It might be there and it might not.
As far as being ticketed if the alcohol is found during a search, you will be ticketed for minor in possession of alcohol. The DA might drop the charges but you would really have to be lucky.
My advice is to start driving your car instead of using your friend's car as soon as possible. I doubt if you can convince her to stop carrying the liquor; so don't bother trying. Just drive a car that is clean of any illegal items and you will have a lot less to worry about.

You need to check the laws of your state but here in IL, even if your of age, you can be arrested for having a open bottle of alcohol in the vehicle.

the 2nd is right. The regulations state that the acquisition and intake of alcohol by a minor is against the regulation. The alcohol isn't unlawful, merely the act of a minor eating it.

As long as the container is not opened.
If the container is opened, it doesn't matter what age you are. It will be looked at suspiciously by authorities.
