I would also like to change his last name as well but his last name is his father's.

Do you and the father have a custody agreement? Is the father listed on the birth certificate? If the answer to either of those is yes, then both you and the father will have to sign legal documents to change the child's name. And when I say custody, I don't just mean physical custody I mean legal custody--in most arrangements each parent has 50% legal custody meaning that they both have to be notified if their child is involved in a legal proceeding (this would qualify).

If you have 100% legal custody and the father is not listed on the birth certificate then you have sole decision in changing first, middle and last name if you choose. You'll have to fill out a form, part of which is a portion explaining why you want the name change (this part is to prevent criminals from changing their legal name to escape legal prosecution), and pay a fee (which will vary depending on where you live but will probably be around $100-$200).

First get with the father then you may havee to go to probate court in you county seat and petition the court for a name change and also if you have had your child baptized the name will also be changed at the church hope this helps

depends on where you live, I live in Australia and you can change your name by deed poll at the births deaths and marriages. But it does cost money and you have to provide Id.
