today this photographer lied to me he said that he wanted to take photos of me for a news paper.
After he took the photos he said they be put in a magazine which I do not approve of.

I told him strait I don't want them photos in that magazine he said well they be in the magazine now.

I did not sign no realise forms for him to use images of me

plus I emailed his boss saying I don't want them in the magazine

can I take him to court

You cannot take him to court because the photos have not been published yet, thus you have no legal course of action. If the photos were taken today there is no way that they have been published in the magazine yet. Until the photos are published, you can do absolutely nothing.

Unfortunately, and contrary to other responses here, you don't have a leg to stand on...

It also appears you are not very wise becuse you failed to mention whether or not you had a contract with this company and / or the photographer that they hired...

If you had a contract then read it close, especially the fine print as the contract rules if it was signed and notarized with a witness...

If there was no contract then it is your word against his and my money is on him...!

It is perfectly legal to photograph "anyone" and place that photograph in a newspaper or magazine under but condition...:

The photograph must not have been taken inside your home without your consent (that means also you must close your window blinds) !

In your situation, you agreed to have the photographs taken and if doing so without a contract then the company using them can do what they want with them and you get nothing in return...

If the company chooses to alter the photographs and even defame or slander you with words surround the photograph, he usually gets away with that also, despite it being illegal... That is because those scum lords have the best lawyers money can buy to get them off the hook and they know they can wear you down to the point you will give in and quit...

Remember, a contract is the bottom line in photography and it should first be approved by a professional before you sign it...

Sorry, but those are the facts...live with them and be more careful next time...

Yes you can!!! The pictures were taken without consent AND he origionally said they were for a newspaper. You should be going to a lawer instead of an internet advice site, though.

You can sue the magazine for printing it and the photographer if they publish it and it is derogatory to you,I would contact a lawyer.

oooh you lucky guy...I don't know what country you're in...but if it's America, and that is a legit magazine...you got yourself a settlement waiting...Take them all the way...if he blurd your eyes then it's legal though. See if you can get them for slander and emotional distress too...collect what's yours!
