If a legal adult solicited a youth aged 16 or older that was emancipated, is it legal for them to have sex?

If it is legal, what makes it alright for a 16 emancipated child to have sex with a legal adult over 18 then just a regular 16 year old? Cause either way, they are both technically have the same brain capablitity.

BUT - an emancipated minor should be considered a legal adult (same as an 18-year old) because the person has proven to the court that they have the intelligence, resources, and capacity to provide for themself, as an adult would be expected to do.

I don't see what sense it would make to declare someone a legal adult and then say because they're under 18 they're a minor again.

Check the state website. Probably the State Supreme Court and look for emancipation documents.

PS I'm not sure all states have emancipation procedures!!!

Every thing depends on the state.
A person over 16 is above the age of consent in many states. Emancipation has no effect here as the relationship is legal.
Some states provide that a person that has been emancipated has the legal ability to consent. This is because the bar is high to get emancipated; they had to prove they were using more of that brain capacity.
In some states the age of consent is over 16 except when the age difference is less than some gap such as 3 or 4 years.

The legality of such an act is dependent upon the state or country in which one lives. There is no special treatment allowed for an emancipated minor.

A. Its illegal to "solicite sex" from anyone.

B. Emancipation has nothing to do with age of consent.

yes it is legal for an emancipated minor to make that decision. the older person wouldn't get in trouble.

Definitely in Louisiana where the age of consent is 14. Anywhere else, probably not...
